These Terms of Sale ("Terms") apply to all purchases made through www.halersmith.com ("we," "our," or "us"). By placing an order, you agree to be bound by these Terms. Please read them carefully before making a purchase.

 

1. Eligibility to Purchase

To place an order on our website, you must be at least 18 years old and capable of entering into a legally binding contract. By placing an order, you represent and warrant that you meet these requirements.

All products are subject to availability, and we reserve the right to limit or cancel quantities available for purchase. We make every effort to display products and colors as accurately as possible, but we cannot guarantee your screen's display will be accurate.

 

3. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes and shipping charges will be added at checkout. We accept the payment methods displayed at checkout, and payment will be authorized before an order is processed, and charged after the order has shipped.

 

4. Order Confirmation and Acceptance

After you place an order, you will receive an email confirmation. This confirmation does not signify our acceptance of your order—it simply acknowledges receipt. We reserve the right to accept or decline your order at any time for any reason.

 

5. Shipping and Delivery

We will make every reasonable effort to ship your order promptly. Shipping times may vary based on location, carrier, and product availability. We are not responsible for delays caused by carriers, weather, or other factors beyond our control.  We only ship to the Lower 48 United States.

 

6. Returns and Exchanges

Please refer to our Return Policy for details on how to return or exchange items. In general, items must be returned in new, unworn condition with original tags and packaging within 30 days of delivery.

 

7. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your purchase or use of our products. Our total liability to you for any claim shall not exceed the amount you paid for the product at issue.

 

8. Warranties and Disclaimers

All products are sold "as is" unless otherwise stated. We disclaim all warranties, express or implied, to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.

 

9. Governing Law

These Terms are governed by the laws of the State of Virginia, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved in the appropriate state or federal courts located in Virginia.
